Hornby trustees defer enforcement on farm and produce stands

The Hornby Island Local Trust Committee passed a standing resolution to defer bylaw enforcement on the non-permitted siting of farm and produce stands. [1]
Bylaw Compliance and Enforcement Manager Warren Dingman said the Hornby Island Land Use Bylaw does not provide regulations permitting farm or produce stands, and that stands would need to be located on an actual lot rather than within a Ministry of Transportation and Infrastructure right of way. [1]
The minutes say staff indicated a farm stand would be a minor contravention of the Land Use Bylaw and that there would be no interest in enforcement of that contravention. [1]
Trustees asked whether the issue could be included in the Land Use Bylaw review project. The Planner said it would need to be included in the project charter and added to the in-scope items. [1]
The Chair recommended that trustees review the Gabriola and North Pender land-use bylaws for information about permitting farm and produce stands, and the Planner said the item would be added to the follow-up action list. [1]
